French Government Plans to Suspend RSA Benefits for Non-Compliance
New regulations could mandate suspension of active solidarity income benefits up to 100% for non-compliance with engagement contracts.
The French government is preparing to implement a new regulatory framework concerning the Revenue de Solidarité Active (RSA), aimed at enhancing compliance among beneficiaries.
A recent document from the Ministry of Labor outlines a proposed scale of penalties for individuals failing to adhere to the obligations established under the law for full employment, which was enacted in December 2023. This legislation includes automatic registration of RSA recipients with France Travail and mandates a minimum of fifteen hours of engagement per week.
Under the forthcoming regulations, known as 'suspension-remobilisation,' local councils or France Travail will have the authority to suspend RSA payments if recipients do not fulfill specific obligations.
The proposed system allows for retroactive payment resumption if the individual rectifies their situation within a designated timeframe.
The relevant decree is expected to be published in the coming weeks, with the government anticipating implementation by June 2024. Until then, the Ministry of Labor is disseminating detailed guidance to local councils about the planned sanctions, including the outlined penalty framework for non-compliance.
